Privacy Policy Introduction and Scope
SizeTracker LLC ("SizeTracker") operates an online shopping web site (the "Site")
and provides services that are designed to assist you, our users, in finding and
shopping online for size and age-appropriate products for children. We are committed
to protecting the privacy and security of the information we may gather about you
and your children, and we appreciate your trust that we will use and share that
information carefully and sensibly.
This privacy policy describes how SizeTracker treats the personally identifiable
information that is collected about you when you visit the Site to which this policy
is linked.
About Children
The Site is not intended for children under the age of 13. We do not knowingly collect
personally identifiable information via the Site from visitors in this age group.
We do, however, collect information about children and babies from their parents.
We ask that our users not provide information about a baby or child without first
getting the parents' consent. We encourage parents to talk to their children about
their use of the Internet and the information they disclose to Web sites.
What is Personally Identifiable Information
"Personally identifiable information" is information that SizeTracker can use to
identify you as an individual. Personally identifiable information includes your
name, address, telephone number and any other information that is connected with
you personally.
Information This Privacy Policy Does Not Apply To
This Privacy Policy does not apply to any other data, including, without limitation,
data that we collect offline or data that others collect on websites that are linked
to the Site. Any information you provide when you visit web sites other than those
covered by this policy or when you purchase any products or services, or enter contests,
that may be linked to or advertised on our web site by companies other than SizeTracker
is subject to the privacy policies posted on those sites. Except as may be otherwise
specified herein, this policy also does not apply to information you may provide
to us offline.
Types of Data Collected; Collection Methods; Combination of Data
The information SizeTracker learns from members helps us personalize and continually
improve your shopping experience at SizeTracker and our participating brands and
retailers. Here are the general types of information we gather.
a)
Information You Give Us: You actively send information to us when you sign up with
us as a member on the Site, participate in surveys or promotions, post product reviews,
make recommendations or requests, mark preferred content, or respond to us or otherwise
contact us. Depending on your choices, you may send us personally identifiable information
such as your email address, name, mailing address, phone number, birthday, and gender;
password; child birthday, name, gender, and body measurements; and shopping preferences.
You can always choose not to provide certain information, but doing so may limit
your ability to use the Site effectively. You can also use certain features of our
Site without telling us your name and if you do not tell us who you are, we do not
try to find out.
b)
Content You Generate on the Site: Any list you create and share publicly, any comment
you make, and any review or rating you provide are displayed with your username
on the Site. Therefore, this information is available to the public and can be associated
with your username. A member may invite other users to join the Site or notify other
individuals of products available on the Site by using the email function and, therefore,
SizeTracker collects these email addresses for the purpose of sending emails.
c)
Information Gathered Automatically: SizeTracker receives and stores certain types
of information whenever you interact with the Site and our participating retailers'
sites to recognize your browser and to provide convenience and other features to
you, such as recognizing you as a SizeTracker member. We track information about
how our Site is used by you through cookies, Internet tags or web beacons, and navigational
data collection. For example, your Internet browser automatically transmits to us
information such as the URL of the website you just came from and the Internet Protocol
(IP) address and the browser version your computer is currently using. The cookies
that we use do not contain and are not tied to personally identifiable information
about you.
d)
Advertising-related Information: In addition, your information may sometimes be
collected by third party service providers with whom SizeTracker contracts. We participate
in multiple ad networks. The ad networks that we participate in collect anonymous
information using cookies to target some of the advertising you see on the Site
and on other third party websites. These companies use cookies and clear gifs to
collect non-personally identifiable information when you visit our web site and
other sites. This information may be used to provide you with better shopping opportunities
through advertisements on this and other web sites that you visit, or to conduct
market research and website analysis.
You can set your browser to notify you when a cookie is sent or to refuse or delete
cookies altogether. By doing so, you may not be able to use certain features on
the SizeTracker Web site.
If you have actively sent us your name or other personally identifiable information,
we may combine such information with tracked information for the purposes set forth
below.
Purposes of Data Collection
Information about SizeTracker members and other users is an important part of our
business. As such, we take steps to maintain the privacy and security of such information
against unauthorized access. We generally use your information for such purposes
as customizing product recommendations, promotional messaging and other shopping
opportunities for you, improving our Site and related services, and communicating
with you if you have authorized such communication. In our efforts to improve your
experience on the Site, we may also share such information in a responsible manner.
For example, we use data to create statistics and reports where personally identifiable
information has been removed and aggregated (such that it is anonymous as regards
any specific user) for various business purposes.
Disclosure of Data
We keep your personally identifiable information confidential and we generally do
not disclose it. But, please note the following clarifications and exceptions:
Our employees and independent contractors have access to some of your personally
identifiable information for the purpose of helping us run our business (and not
for their own purposes). They access and use such data subject to our instructions,
on a "need to know" basis and under confidentiality and security obligations.
If we ever sell the Site or a substantial part of our business, we may disclose
your personally identifiable information to a (prospective) buyer on the condition
that such buyer agrees to comply with this Privacy Policy.
We may also share your personally identifiable information to respond to law enforcement
requests, court orders or other legal process or if we believe that such disclosure
is necessary to investigate, prevent or respond to illegal activities, fraud, physical
threats to you or others or as otherwise required by any applicable law or regulation.
Even though we do not provide any personally identifiable information about you
specifically to any advertising customers, they can occasionally find out information
indirectly. For example, we may agree on target audiences for a particular advertisement,
such as a sales promotion provided to parents who have indicated a preference for
a specific brand. If you choose to respond to such targeted advertisements, the
advertiser may deduce that you are a member of the target audience to whom we sent
the ad.
Before we disclose your personally identifiable data to a third party for their
own business purposes (such as a survey or a sweepstake), we will first obtain your
consent, for example via email, click-through, an online opportunity to opt-out
or otherwise.
We freely use and disclose data in anonymous form, for example, in statistics or
reports to our advertising customers.
Please remember that if you post any information in areas of our Site that are generally
accessible to users, such as in product reviews, it will be available to the public.
Security
We take reasonable steps to protect personally identifiable information from loss,
misuse, and unauthorized access, disclosure, alteration, or destruction. But, you
should keep in mind that no Internet transmission is ever completely secure or error-free.
In particular, e-mail sent to or from the Site may not be secure.
Access and Correction; Comments and Questions
Please keep your personally identifiable information, accurate, current, and complete
by routinely updating your user and child profiles. If you have any questions, comments
or concerns regarding this Privacy Policy, please contact us by using our
contact form.
Opt-Out, Communication Preferences
You may modify your communication preferences and/or opt-out from specific communications
at any time. Please specify and adjust your preferences
here.
Changes to This Privacy Policy
This Privacy Policy was last updated on October 21, 2009. We reserve the right to
amend it from time to time and if we change it materially, we will post a revised
version on the Site. Please check back periodically, and especially before you provide
any personally identifiable information to us.
Terms of Service
Note also that your use of the Site is subject to our
Terms of Service, which contain disclaimers,
limitations of liability and information regarding Utah law.
